1. USER INFORMATION

DISTROLUX, SL, hereinafter the CONTROLLER, is the Controller of the processing of the User's personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD), and therefore provides you with the following information on the processing:

Purpose of processing: To maintain a business relationship with the User. The operations planned for processing are:

  • Sending commercial advertising communications via email, fax, SMS, MMS, social media, or any other electronic or physical means, present or future, that allows for commercial communications. These communications will be sent by the CONTROLLERS and will relate to their products and services, or those of their partners or suppliers with whom they have reached a promotional agreement. In this case, third parties will never have access to personal data.
  • Conduct statistical studies.
  • To process orders, requests or any type of request made by the user through any of the contact methods available to them.
  • Send the website newsletter.

Legal basis for processing: consent of the data subject.

Data retention criteria: data will be kept for no longer than necessary to maintain the purpose of the processing and when it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure the pseudonymization of the data or its total destruction.

Communication of data: Data will not be communicated to third parties, except where legally required.

Rights that the User has:

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By checking the corresponding boxes and entering data in the fields marked with an asterisk (*) on the contact form or download forms, Users expressly and freely and unequivocally accept that their data is necessary for the provider to process their request. Providing data in the remaining fields is voluntary. The User guarantees that the personal data provided to the CONTROLLERS is accurate and is responsible for communicating any changes to it.

The CONTROLLERS expressly inform and guarantee users that their personal data will not be transferred to third parties under any circumstances, and that whenever any type of transfer of personal data is to be carried out, the express, informed, and unambiguous consent of the Users will be requested beforehand. All data requested through the website is mandatory, as it is necessary for providing optimal service to the User. If all the data is not provided, it cannot be guaranteed that the information and services provided will be fully tailored to their needs.

3. SECURITY MEASURES

That in accordance with the provisions of the current regulations on the protection of personal data, the CONTROLLERS are complying with all the provisions of the GDPR regulations for the processing of personal data under their responsibility, and manifestly with the principles described in Article 5 of the GDPR, by which they are processed lawfully, fairly and transparently in relation to the interested party and adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The CONTROLLERS guarantee that they have implemented appropriate technical and organizational policies to apply the security measures established by the GDPR in order to protect the rights and freedoms of Users and have communicated to them the appropriate information so that they can exercise them.

OBJECT AND SCOPE OF APPLICATION

These General Conditions are intended to regulate the relationship between Distrolux, SL (hereinafter Distrolux) and you (hereinafter the Client), relating to all transactions carried out through the website munster-records.com (hereinafter the website), a domain owned by Distrolux, a legally constituted association, with CIF number B83038125.

Furthermore, the online contracting of services offered by Distrolux through this website will be subject to the provisions of the website's Legal Notice. In the event of any conflict between this notice and these General Terms and Conditions, the latter will always prevail.

ACCEPTANCE AND PROOF OF ACCEPTANCE

The purchase of the products must be made by activating the I ACCEPT PAYMENT CONDITIONS button that appears at the bottom of the purchase request, and expresses the full acceptance of each and every one of the General Conditions as shown on the Distrolux website prior to the purchase of the products, without any changes that may occur in the clauses of the General Conditions being applicable to you afterward.

From the moment of acceptance, the user acquires the status of Distrolux Customer as described in these General Terms and Conditions. Any product or service offered subsequently by Distrolux will require a new contract.

If the Customer wishes to read the General Conditions in more detail, they can print the document on paper or save it in electronic format.

Distrolux will send the Client, once these General Conditions have been expressly accepted, proof of the contract made, with all its terms, via email.

Distrolux informs you that, for legal reasons, it archives the electronic documents formalizing purchases.

If the Customer makes a mistake when submitting the data, they can correct it by sending an email to ventas@munster-records.com. If the corrected information pertains to the postal address where the Customer requested delivery of the purchased product, and the product has not yet been shipped, it will be sent to the new address provided. Otherwise, the Customer must wait for delivery and initiate the appropriate return process.

PRICES, PAYMENT METHOD, DELIVERY AND WITHDRAWAL

PRICES

The prices applicable to each product are those indicated on the website on the date of the order, including Value Added Tax (hereinafter, VAT).

For deliveries of goods taking place in countries outside the European Union, Distrolux will not assume the cost of taxes and customs duties specific to each country, these being the responsibility of the recipient of the product.

Shipping costs and their corresponding VAT are always indicated in the order.

The shipping costs displayed on the website when placing an order are estimates and are calculated based on an approximate average weight per book, taking into account the number of pages, dimensions, and binding.

Distrolux reserves the right to adjust shipping costs when the weight of the ordered items is not listed on the corresponding product page. In such cases, the company will notify the customer of the change via email, and the customer may choose to cancel their order without incurring any additional charges.

Special offers will be clearly marked and identified as such, indicating both the original price and the offer price.

Distrolux reserves the right to make any modifications it deems appropriate to the website at any time and without prior notice, and may update products and services according to market conditions.

If a product or products ordered by the customer have experienced a price increase by the manufacturer and this has not been updated on the website, Distrolux reserves the right to increase the final shipping cost. In such cases, Distrolux will notify the customer of the change via email or telephone, and the customer may choose to cancel their order without incurring any additional costs.

METHOD OF PAYMENT

Purchases can be paid for by any of the following means:

  • Card (Visa and Master Card): Available for all countries.

DELIVERY

In the event that the Customer requests an item(s) that is out of stock, discontinued or impossible to obtain and that is not properly indicated in the item's information sheet, Distrolux will notify the Customer of this issue and, where appropriate, undertakes to refund the amount paid by the customer for said item(s), processing, if any, the rest of the order placed by the customer.

Distrolux ships orders to its customers via:

The courier service uses several courier companies for the Spanish mainland. The customer will receive the order at the address indicated on the web form, designated as the "Shipping Address." Distrolux will notify the customer by email or telephone when the shipment has been dispatched. It is the customer's responsibility to monitor the arrival of the shipment to avoid subsequent returns and to provide Distrolux with complete and accurate information necessary for proper delivery.

Delivery times will vary depending on the physical availability or stock of the requested products. If the products are in stock, the estimated delivery time will be 48 to 72 hours on business days from the time the shipment leaves the warehouse. If the products are not in stock, they will need to be ordered from the corresponding distributors, so the delivery time will be longer.

From the State Postal Service for the entire national insular territory and autonomous cities (Balearic Islands, Canary Islands, Ceuta and Melilla).

The Customer must collect the shipment at the Correos y Telégrafos, S.A. office corresponding to their residential address. Distrolux will notify the Customer by email or telephone that the shipment has been dispatched and will provide a tracking number to monitor its status and the estimated arrival date at the post office.

Correos usually sends a notification to the Customer's address informing them that the shipment has arrived at the post office for collection, although this notification is not always successful. It is the Customer's responsibility to monitor the shipment's arrival to avoid subsequent returns.

Delivery times will vary depending on the physical availability or stock of the requested products. If the products are in stock, the estimated delivery time will be 10 to 15 business days, according to postal service delivery times.

The delivery date to the customer's address depends on the availability of the chosen product and the shipping area. Delivery times are approximate and may vary depending on the specific circumstances of each order.

WITHDRAWAL

Distrolux guarantees the Customer the possibility of cancelling their order at any time and at no cost, provided that the cancellation is communicated before the order has been handed over to the carrier for shipment.

The Customer will have a minimum of 7 business days from receipt of the goods or from the date of purchase (if it is a service) to terminate the contract.

The returned order must be delivered along with the delivery note and, if applicable, the invoice issued by Distrolux. The customer is responsible for the return shipping costs.

If a product other than the one ordered by the customer is delivered due to an error by Distrolux, the correct product will be delivered at no additional charge.

If a product arrives broken, damaged or in poor condition, Distrolux undertakes to replace it with another in good condition, at no additional charge.

SERVICE REQUIREMENTS

To acquire the contracted services, you only need to register as a Customer on the Distrolux website and fill out the purchase form with your personal and payment information.

LANGUAGE

The language in which the contract between Distrolux and the Client will be perfected is Spanish.

DISTROLUX RESPONSIBILITIES

Distrolux guarantees the quality of the service contracted through the website munster-records.com. All rights guaranteed to consumers and users under applicable law are also guaranteed.

CUSTOMER RESPONSIBILITIES

The Client agrees to use the Services lawfully, without violating current legislation or infringing the rights and interests of third parties.

The Client guarantees the truthfulness and accuracy of the data provided when completing the contract forms.

PERSONAL DATA AND COMMERCIAL COMMUNICATIONS

In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, the Client is informed that the personal data provided will be incorporated into a file owned by Distrolux.

The Client may exercise the rights of access, rectification, cancellation and opposition by written communication addressed to Distrolux at C/JOSE GURRUCHAGA 12-4ºG 48980 SANTURTZI – BIZKAIA (Spain), or by email to atencion@munster-records.com.

INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights to the works, trademarks, logos, and any other protectable content on the Distrolux website belong exclusively to Distrolux or to third parties who have authorized their inclusion on the website.

JURISDICTION AND APPLICABLE LAW

In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter will be those provided by the applicable legal regulations regarding competent jurisdiction.

In the case of a sale made by a company, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of SANTURTZI (Spain).

PARTIAL NULLITY

If any of these terms and conditions is declared invalid, illegal, or unenforceable by any court of competent jurisdiction, such term and condition shall be deemed severed, and the remainder of the Agreement shall remain in full force and effect.

JURISDICTION AND APPLICABLE LAW

This contract shall be governed by Spanish law. For any disputes or claims arising from the interpretation of these terms and conditions, both parties submit to the jurisdiction of the competent Spanish courts.

Why are so many warnings about the use of "cookies" popping up now?

In 2012, an amendment was introduced to Article 22.2 of the Law on Information Society Services and Electronic Commerce (LSSICE) of 2002.

How long will it take for my order to arrive?

Orders are delivered within 24-72 business hours from the time they are placed (mainland Spain only; the Balearic Islands, Canary Islands, Ceuta, and Melilla are excluded).

All shipments will be handled by Correos Express. If, for any reason, your order is delayed, we will contact you.

Once an order has been placed, the shipping address cannot be changed unless the customer agrees to cover the additional costs and the change is expressly accepted by both parties.

What is the shipping cost?

Shipping costs are not included in the price of the items. These will be itemized in your order summary.

Shipping costs are calculated based on the destination and weight, so we cannot provide a fixed list of rates.

Shipping is free for orders over €100 (mainland Spain only; the Canary Islands, Balearic Islands, Ceuta, and Melilla are excluded).

Can I request that an order be shipped outside of Spain?

Yes, this option is currently available.

What happens if I'm not at the address I provided when the courier arrives to deliver the order?

After the first delivery attempt, the carrier will leave a notification so you can contact them and schedule a new delivery date.

This delivery can be made either to the shipping address you originally provided or to one of the carrier's offices.

After another failed delivery attempt, your order will be canceled and we will refund the purchase price minus the return shipping costs.

What do I do if my order doesn't arrive?

If you have not received your order within 5 business days of confirmation, please contact us at atencion@munster-records.com.

Can I send my order as a gift?

We do not offer the option to send gifts through our online store.

Can I pick up my order at one of your stores?

We do not have a physical store.

Shipping costs (both delivery and returns) will only be refunded when DISTROLUX is responsible for the reason for the return (for example, an incorrect product was sent or the product arrived in poor condition).

All communications involving sensitive data are secured with an SSL certificate, and we rely on two payment platforms.

The first allows payment with Visa and MasterCard debit and credit cards through Bankia, which integrates CES 6 (Secure Electronic Commerce).

Under the international protocols Verified by Visa and MasterCard SecureCode — both based on 3D Secure technology — this provides high security and protection for payments.

We also accept payments through PayPal, a platform that protects your financial information with industry-leading fraud prevention and security systems.

PayPal is a globally recognized online payment system. When using PayPal, your financial information is never shared with the seller.
